By accessing Orkap ("Service"), you agree to these legally binding Terms. If you represent an entity, you warrant authority to bind them. If you disagree, do not use the Service.
Orkap is a cold email outreach tools, including email management, tracking, automation, and analytics. You acknowledge that email deliverability depends on external factors (e.g., ISP policies, recipient settings).
You must be ≥16 years old.
Provide accurate registration data and safeguard credentials.
Notify us immediately of unauthorized account use.
You agree to:
Comply with all anti-spam laws (CAN-SPAM, GDPR, CASL, etc.).
Never send emails to purchased/scraped lists without explicit consent.
Include opt-out links and your physical address in campaigns.
Honor unsubscribe requests within 48 hours.
Maintain recipient consent records.
Violations may trigger immediate account termination.
Paid plans auto-renew monthly/annually.
Fees are non-refundable except under our Refund Policy.
Cancel before renewal to avoid charges.
Price changes require 30-day email notice.
You retain rights to your contacts, templates, and campaign data ("User Content").
Grant Orkap a non-exclusive license to process User Content solely to operate the Service.
Do not upload illegal/offensive content.
You will not:
Send spam, phishing, or harassing emails.
Reverse-engineer, scrape, or disrupt Orkap’s infrastructure.
Exceed email sending limits or bypass rate controls.
Impersonate others or violate third-party rights.
We process data per our Privacy Policy.
EU users: You warrant lawful consent mechanisms for recipients.
Do not submit EU personal data without signing our DPA.
Either party may terminate with 30 days’ notice.
We may suspend accounts violating these Terms.
On termination:
Access ceases immediately.
Data is deleted after 30 days (backups excluded).
Service provided "AS IS." No guarantees of deliverability, uptime, or accuracy.
Not liable for:
Damages from email blocks/bounces.
Third-party integrations (e.g., Gmail, Outlook).
User disputes with email recipients.
Maximum liability = fees paid in the last 6 months.
We may update these Terms with 30 days notice (email or in-app). Continued use = acceptance.
